(\u201cOwnRyde,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d).<\/p><p>By creating an account or using the Platform, you (\u201cUser,\u201d \u201cRider,\u201d or \u201cDriver\u201d) agree to be legally bound by these Terms.<\/p><p>OwnRyde operates a technology platform that connects riders with independent transportation providers.<\/p><p><strong>1. About OwnRyde<\/strong><\/p><p>OwnRyde provides a software platform that allows Riders to connect with independent Drivers who offer transportation services.<\/p><p>OwnRyde does not:<\/p><ul><li>Provide transportation services<\/li><li>Employ drivers<\/li><li>Own, lease, or operate vehicles<\/li><li>Control or supervise Drivers<\/li><li>Guarantee ride availability<\/li><li>Guarantee ride acceptance<\/li><li>Guarantee response times<\/li><li>Guarantee ride quality or outcomes<\/li><\/ul><p>Transportation services are independently provided by Drivers.<\/p><p>Drivers operate independently and are solely responsible for their transportation services, vehicles, conduct, insurance, licenses, permits, and compliance with applicable laws.<\/p><p><strong>2. Eligibility<\/strong><\/p><p>To use the Platform, Users must:<\/p><ul><li>Be at least 18 years old to create a Rider account<\/li><li>Be at least 21 years old to create a Driver account<\/li><li>Provide accurate and truthful information<\/li><li>Complete required verification processes<\/li><li>Maintain a valid payment method (Riders)<\/li><li>Maintain required licenses, insurance, and permits (Drivers)<\/li><\/ul><p>OwnRyde reserves the right to approve, deny, suspend, restrict, or terminate accounts at its sole discretion for lawful reasons including safety concerns, fraud prevention, policy violations, or incomplete documentation.<\/p><p><strong>3. Nature of the Platform<\/strong><\/p><p>OwnRyde is a technology platform.<\/p><p>The Platform facilitates:<\/p><ul><li>Rider and Driver account creation<\/li><li>Ride request and dispatch systems<\/li><li>Driver matching<\/li><li>Fare estimates<\/li><li>Payment processing<\/li><li>Communication tools<\/li><li>Navigation and location-based services<\/li><\/ul><p>OwnRyde may use platform-generated pricing systems, suggested pricing structures, dispatch prioritization systems, estimated fare calculations, availability-based pricing adjustments, and other marketplace tools to improve rider experience and marketplace consistency.<\/p><p>Drivers may have access to suggested pricing systems or custom pricing features where available.<\/p><p>Ride requests may be prioritized based on multiple factors including pricing structure, driver availability, rider location, estimated arrival time, acceptance rates, platform activity, safety considerations, or operational efficiency.<\/p><p>OwnRyde does not guarantee that any Driver will receive ride requests or earnings opportunities.<\/p><p><strong>4. User Accounts<\/strong><\/p><p>Users agree to:<\/p><ul><li>Maintain accurate account information<\/li><li>Keep login credentials secure<\/li><li>Not share accounts<\/li><li>Not create fraudulent or duplicate accounts<\/li><li>Immediately report unauthorized access<\/li><\/ul><p>OwnRyde may suspend or terminate accounts suspected of fraud, abuse, unauthorized access, or policy violations.<\/p><p><strong>5. Rider Responsibilities<\/strong><\/p><p>Riders agree to:<\/p><ul><li>Treat Drivers respectfully<\/li><li>Follow applicable laws<\/li><li>Provide accurate pickup and destination information<\/li><li>Avoid unsafe or unlawful conduct<\/li><li>Not transport prohibited or illegal items<\/li><li>Pay applicable ride charges, tolls, cancellation fees, and adjustments<\/li><li>Maintain valid payment information<\/li><li>Avoid damaging vehicles<\/li><\/ul><p>Fare estimates provided through the Platform are estimates only and may change based on route adjustments, tolls, waiting time, destination changes, traffic conditions, availability, or other operational factors.<\/p><p>Final pricing will be displayed before ride confirmation whenever applicable.<\/p><p><strong>6. Driver Responsibilities<\/strong><\/p><p>Drivers agree to:<\/p><ul><li>Maintain all legally required licenses, permits, and insurance<\/li><li>Maintain vehicles in safe operating condition<\/li><li>Operate lawfully and professionally<\/li><li>Complete required verification and background check processes<\/li><li>Maintain accurate documentation<\/li><li>Follow applicable laws and regulations<\/li><li>Report accidents, incidents, or safety concerns when required<\/li><\/ul><p>Drivers are independent contractors and are solely responsible for their transportation activities and legal compliance.<\/p><p>Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between OwnRyde and Drivers.<\/p><p><strong>7. Payments &amp; Platform Fees<\/strong><\/p><p>Riders authorize OwnRyde and its payment processors to charge payment methods for:<\/p><ul><li>Ride fares<\/li><li>Booking or platform fees<\/li><li>Tolls<\/li><li>Cancellation fees<\/li><li>Adjustments<\/li><li>Other applicable charges<\/li><\/ul><p>Drivers authorize OwnRyde and its payment processors to process payouts and applicable fees through third-party payment providers including Stripe Connect or similar services.<\/p><p>Tips are intended for Drivers.<\/p><p>OwnRyde does not store full payment card information.<\/p><p><strong>8. Background Checks &amp; Verification<\/strong><\/p><p>Drivers may be required to complete identity verification, document verification, background screening, driving record checks, insurance verification, or additional compliance reviews through third-party providers.<\/p><p>OwnRyde reserves the right to deny or revoke Driver access based on verification results or safety concerns.<\/p><p>Completion of background checks does not guarantee safety, suitability, or future conduct.<\/p><p><strong>9. Prohibited Activities<\/strong><\/p><p>Users may not:<\/p><ul><li>Violate laws or regulations<\/li><li>Commit fraud or deceptive activity<\/li><li>Harass, threaten, or abuse other Users<\/li><li>Interfere with Platform functionality<\/li><li>Circumvent the Platform for unauthorized transactions<\/li><li>Provide false information<\/li><li>Use the Platform for unlawful activity<\/li><li>Attempt unauthorized access to systems or accounts<\/li><\/ul><p>Violations may result in immediate suspension or permanent removal.<\/p><p><strong>10. Safety &amp; Incidents<\/strong><\/p><p>OwnRyde may provide safety tools, location-sharing features, emergency assistance integrations, verification systems, and incident reporting tools.<\/p><p>However, OwnRyde cannot guarantee the safety, conduct, actions, identity, quality, or behavior of any User.<\/p><p>Users are responsible for exercising personal judgment and caution while using the Platform.<\/p><p><strong>11. Insurance<\/strong><\/p><p>Drivers are solely responsible for maintaining all legally required insurance coverage.<\/p><p>OwnRyde does not provide insurance coverage for Drivers, Riders, vehicles, property, or third parties unless explicitly stated otherwise in writing.<\/p><p><strong>12. Disclaimers<\/strong><\/p><p>The Platform is provided on an \u201cas is\u201d and \u201cas available\u201d basis.<\/p><p>OwnRyde makes no warranties, express or implied, regarding:<\/p><ul><li>Availability<\/li><li>Reliability<\/li><li>Ride quality<\/li><li>Safety<\/li><li>Driver conduct<\/li><li>Rider conduct<\/li><li>Earnings<\/li><li>Platform uptime<\/li><li>Matching success<\/li><li>Transportation outcomes<\/li><\/ul><p>Use of the Platform is at your own risk.<\/p><p><strong>13. Limitation of Liability<\/strong><\/p><p>To the fullest extent permitted by law, OwnRyde shall not be liable for:<\/p><ul><li>Personal injury<\/li><li>Death<\/li><li>Property damage<\/li><li>Vehicle damage<\/li><li>Lost profits or income<\/li><li>Business interruption<\/li><li>Emotional distress<\/li><li>Criminal acts<\/li><li>Transportation incidents<\/li><li>Insurance disputes<\/li><li>User conduct<\/li><li>Indirect or consequential damages<\/li><\/ul><p>Users assume all risks associated with transportation services arranged through the Platform.<\/p><p><strong>14. Indemnification<\/strong><\/p><p>Users agree to indemnify and hold harmless OwnRyde, its officers, directors, affiliates, employees, contractors, and partners from claims, damages, liabilities, expenses, or legal costs arising from:<\/p><ul><li>Use of the Platform<\/li><li>Transportation activities<\/li><li>Violations of these Terms<\/li><li>Violations of law<\/li><li>User conduct<\/li><li>Disputes between Users<\/li><\/ul><p><strong>15. Account Suspension &amp; Termination<\/strong><\/p><p>OwnRyde may suspend, restrict, or terminate accounts for:<\/p><ul><li>Safety concerns<\/li><li>Fraud<\/li><li>Policy violations<\/li><li>Insurance lapses<\/li><li>Failed verification<\/li><li>Unlawful activity<\/li><li>Harassment<\/li><li>False information<\/li><li>Risk management purposes<\/li><\/ul><p>Users may stop using the Platform at any time.<\/p><p><strong>16. Privacy<\/strong><\/p><p>Use of the Platform is subject to the OwnRyde Privacy Policy.<\/p><p><strong>17. Arbitration Agreement<\/strong><\/p><p>Any dispute arising from these Terms or use of the Platform shall be resolved through binding arbitration in the State of Oregon, unless prohibited by applicable law.<\/p><p>Class actions and collective proceedings are waived to the fullest extent permitted by law.<\/p><p><strong>18. Changes to These Terms<\/strong><\/p><p>OwnRyde may update these Terms at any time.<\/p><p>Continued use of the Platform after updates constitutes acceptance of the revised Terms.<\/p><p><strong>19.
